User Agreement
Welcome to 24-7auction.com! You must agree to the following Terms
and Conditions to become a user-member of 24-7auction.com. This agreement is
effective June 17, 2010 for all users and upon acceptance for new users. Before
you use 24-7auction.com site you must read and accept the following user
agreement and privacy policy. Terms and Conditions may be modified at anytime
and you by accepting consent to any additional changes made.
1)
Sellers and bidders shall provide 24-7auction.com
with the following: full name, address, phone number, driver’s license or state
ID number. A form of payment such as credit card or a cash deposit maybe
required for bidding. You must be of legal age 18 years to participate.
2)
All items are sold “As is, Where is” Condition:
Ample inspection times will be given for the items listed with the start and end
dates of any listed items. The seller and 24-7auction.com expressly disclaims
any warranty concerning the condition, quality, and nature, fitness for
particular purpose, value or merchantability of any such item. No allowances
will be made for any imperfections, errors or mistakes in listing. Bidders are
encouraged to inspect items. The online pictures and photographs are included as
a convenience and are not to be taken as any implicit representation of any
warranty or genuine or condition of any item.
24-7auction.com relies on information from the sellers and make no
warranties regarding condition, the accuracy or genuine of the item.
3)
Sellers may remove an item from the auction
listing only if there is no bid on the item yet. Once there is a bid on the item
the seller must abide by 24-7auction.com’s policy and the item will remain at
auction and be sold to the highest bidder. In the event a seller removes and
item before a bid is received on the item, the seller will be assessed a closing
fee from 24-7auction.com. Repetitive removals by a seller may warrant suspension
of selling privileges.
4)
Winning bidders are to pay for each item won
within 48 hours of auction end. Winning bidder must remove won items within 48
hours or make arrangements for delivery or shipment of won item(s) beforehand
(this can be done at the 24-7auction.com office.) Winning bidders remove their
won items at their own cost, expense, liability and risk. Regardless no item is to leave the
premises unless s paid for. Rights of the winning bidder to purchase the item
will end after 48 hours. Any item that is won and not removed in the appropriate
timeframe will be considered abandoned by the winning bidder and will be
disposed of according to 24-7auction.com’s discretion. Winning bidders that fail
to complete a transaction will be held responsible for any damages, resulting
from their failure to complete, but not limited to storage costs, interest,
filing fees, and attorneys fees.
5)
All items listed in each auction will be sold to
the highest bidder, unless the seller has set a minimum reserve price. There
also may be set prices listed or buy it now items that are non biddable items
but can be purchased for a fixed price. Disputes on bidding will be settled by
24-7auction.com by reviewing records kept by 24-7auction.com. All decisions made
by 24-7auction.com are final.
6)
No claims will be allowed once an item is removed
from the auction site. All items are sold “As is Where Is”. If an item that is
won is lost or destroyed and the winning bidder has paid for said item. The
winning bidder will be given a full refund for the money the winning bidder has
paid for the item. 24-7auction.com cannot be held responsible for any lost or
damaged items and cannot be held liable for any such costs of repairs, potential
profits, or lost goods exceeding the cost paid for the won item.
7)
By participating in the 24-7auction.com auctions,
bidders represent and irrefutably warrant and convey that they shall not
misrepresent their ability to close on any transaction the bidder enters into by
participating in the auction. Any bid the bidder makes will constitute an
irrevocable offer to purchase the item at the full amount of the bid plus a 10%
buyer’s premium fee and any applicable taxes owed. Bidder also warrants that the
bidder has the legal authority to enter into an agreement to purchase the item
and will forfeit any deposits or payments made as damages but not limited to
such deposits if damages exceed the amount of deposit. Bidder then agrees to pay
for any costs for filing fees, attorney costs to recoup damages.
8)
If bidder makes and error in bidding you must
notify 24-7auction.com immediately, you may still be held liable for any bids
placed.
9)
Any auction that has malfunctioned, lost service,
shutdown may be construed as null and void, in any event 24-7auction.com will
remedy the situation that will benefit the sellers which will include cancelling
all bids and starting the auction over. 24-7auction.com shall not be held liable
for any malfunctions, shutdowns or loss of services.
10)
Winning bidders shall be totally responsible for picking up
winning bid items, assemble, disassembly and loading. Winning bidders agree to
pay for and remove won items from 24-7auction.com within 48 hours of auction end
time. As stated above items can be shipped or delivered if prior arrangements
have been made and paid for.
11)
Each item has a specific closing time end of auction for that
item; items are normally grouped so a group of items will close at a specific
time each day specified. Winning bidders will be sent invoices for pickup,
winning bidders shall agree to pay the winning bid price plus the 10% buyer’s
premium and any applicable tax on all items won. Forms of payment that are
accepted are: Cash, Cashier’s check, money order, all made payable to
24-7auction.com. Other forms of payments we will accept are credit and debit
cards, Personal Checks, and PayPal, a 3% fee will be added for these services. PayPal will require
at least a 24 hour hold so if you use this method pay for your purchase at least
a day before pickup.
12)
24-7 auction.com is acting as agent only and not responsible
for any of the principals involved.
13)
Bidders and purchasers agree to indemnify and will hold
harmless both the sellers and Mercer Auction Co., LLC and 24-7auction.com from
and against all claims and liabilities resulting from the online auctions
including but not limited to any consequential damages, proximate, failure to
comply with any state local or federal laws and the cost of any legal expenses
arising there from. No persons shall have any claims against Mercer Auction Co.,
LLC or 24-7auction.com or their employees or agents for any injuries or damages
sustained to or loss of property that may occur at the auction site.
14)
The above terms and conditions and all questions with respect
to the interpretations shall be governed and construed in accordance to the
internal laws of the State of Wisconsin, without regard to conflict of law’s
provisions, all bidders expressly consent to personal and exclusive jurisdiction
in the courts of the state of Wisconsin located in Eau Claire County. In bidding
you consent to agreeing to with all terms and conditions stated above and any
auction specific terms posted on each auction event page and or terms emailed to
you and or terms posted on 24-7auction.com.
15)
By registering for this site you state you have read the terms
and conditions considered as the bidders contract and agree to all the terms and
conditions set forth.

1)
SELLERS, CONSIGNOR,
AGREE TO CONSIGN THEIR ITEM TO MERCER
AUCTION CO., LLC HEREIN REGARDED TO 24-7AUCTION.COM TO SELL FOR THE HIGHEST BID,
OR PLACEMENT ON THE WEBSITE FOR A FIXED PRICE AS AGREED UPON BY OWNER AND
24-7AUCTION.COM.
2)
EVEN IF YOU HAVE A BUYERS ACCOUNT YOU MUST
REGISTER FOR A SELLERS ACCOUNT.
3)
ITEMS MUST BE APPROVED FOR CONSIGNMENT BY
24-7AUCTION.COM. PLEASE REVIEW THE LIST OF ITEMS NOT TAKEN FOR CONSIGNMENT. EVEN
IF THE ITEM IS NOT LISTED ON THE LIST 24-7AUCTION.COM HAS THE RIGHT TO REFUSE
ANY ITEM FOR LISTING.
4)
SELLERS MUST BE OF LEGAL AGE (18) AND OWN THE
ITEM BEING AUCTION OR THE RIGHT TO DISPOSE OF SAID ITEM.
5)
SELLERS WILL FURNISH PICTURE ID SUCH AS DRIVERS
LICENSE OR STATE ID CARD THAT IS CURRENT AND CURRENT PHONE NUMBER.
6)
24-7AUCTION.COM WILL NOT ACCEPT FOR CONSIGNMENT
ANY ITEMS THAT ARE ILLEGAL OR IMMORRAL.
7)
SELLERS AGREE TO PICK UP ANY UNSOLD ITEMS WITHIN
48 HOURS OF THE END OF THE AUCTION OR RELIST AND PAY ANY RELIST FEE OR AD FEE. IF SELLER DOES NOT PICK UP ITEMS THAT HAVE NOT BEEN SOLD WITHIN 15 DAYS THE ITEMS BECOME THE PROPERTY OF 24-7AUCTION.COM AND MERCER AUCTION CO. LLC. AND WILL EITHER BE RESOLD OR DISPOSED OF ACCORDINGLY TO COVER STORAGE FEES.
8)
UNSOLD ITEMS THAT ARE NOT PICKED UP WITHIN THE 48
HOUR TIMEFRAME OR AGREED TO BE RELISTED AND PAY ASSOCIATED COSTS, WILL BE
ASSESSED A STORAGE FEE OF NOT LESS $1.50 AND NOT GREATER THAN $7.50 PER DAY
DEPENDANT ON THE SIZE OF THE ITEM.
9)
SELLERS AGREE TO HOLD HARMLESS, MERCER AUCTION
CO., LLC OR 24-7AUCTION.COM FOR ANY LOSS OR DAMAGE TO ANY ITEM CONSIGNED. IT IS
ALSO ADVISED THAT SELLER MAINTAIN INSURANCE ON THE ITEM WHILE IT IS BEING
AUCTIONED.
10)
24-7AUCTION.COM WILL MAKE SETTLEMENT ON ANY ITEM SOLD TO THE
HIGHEST BIDDER LESS ANY FEES WITHIN 48 HOURS OF PAYMENT FOR ANY SUCH ITEM.
11)
24-7AUCTION.COM MAINTAINS SEVERAL METHODS OF FOR WHICH SELLERS
CAN CHOOSE TO LIST ITEMS, ONLINE AUCTION 3 OR 5 DAY, RESERVED AUCTION, FEATURED
LISTING, BUY IT NOW OR WE CAN PURCHASE DIRECTLY FROM YOU.
12)
24-7AUCTION.COM WILL LET SELLERS BRING IN 1 ITEM OR UNLIMITED
ITEMS FOR CONSIGNMENT. WE ALSO DO OFFER PICKUP SERVICE FOR CUSTOMERS. YES THERE
IS A COST ASSOCIATED WITH THIS CALL FOR PRICES WE ALSO.
13)
SELLER MAY REMOVE AN ITEM FROM CONSIGNMENT AUCTION AT ANYTIME
BEFORE THE AUCTION STARTS OR UP UNTIL THE ITEM HAS A BID. ONCE THE ITEM HAS A
BID THE ITEM WILL BE SOLD TO THE HIGHEST BIDDER. IF THE SELLER STILL WANTS THE
ITEM BACK, SELLER CAN INSTRUCT THE AUCTIONEER TO BID FOR THE SELLER TO OBTAIN
THE ITEM. THE SELLER WILL THEN PAY 24-7AUCTION.COM THE APPROPRIATE FEES.
14)
24-7AUCTION.COM IS ACTING AS AN AGENT AND IS NOT RESPOSIBLE FOR
ACTIONS OF PRINCIPALS.
15)
24-7AUCTION.COM WILL DO ITS UTMOST TO PROMOTE EACH AUCTION FOR
VISIBILITY AND TRY AND OBTAIN THE BEST PRICE FOR YOUR ITEMS.
16)
SELLERS ARE TO REPRESENT THEIR ITEMS ACCURATELY AND HONESTLY,
THAT BUILDS TRUST AS YOUR USER NAME WILL BE OUT THERE, ITEMS WILL BE FOR PUBLIC
VIEWING SO BE HONEST ABOUT WORKING ORDER AND CONDITIONS AS BIDDERS WILL BE ABLE
TO SEE ALSO. AS STATE IN OTHER SECTIONS IT IS OK TO SELL A PARTS PIECE BUT MUST
BE STATED AS SUCH-NO JUNK ITEMS!
17)
24-7AUCTION.COM HAS THE RIGHT TO DENY A SELLER PRIVLIGES FOR
ANY REASON LISTED ABOVE OR NON PAYMENT OF FEES TO 24-7AUCTION.COM. SELLER ALSO
AGREES TO REIMBURSE ANY REASONABLE FEES ASSESSED FOR ANY COLLECTION MATTERS
24-7AUCTION .COM INCURRS COLLECTING FEES OWED TO 24-7AUCTION.COM.
18)
SELLERS WISHING TO RELIST AN ITEM THAT WAS AT AUCTION BEFORE
MUST REDUCE PRICE OF ITEM BY 50% AND PAY A RELISTING FEE TO RELIST.
19)
24-7AUCTION.COM WILL DEDUCT ANY FEES DUE TO 24-7AUCTION.COM
BEFORE SETTLEMENT TO SELLERS. ANY RESERVE PRICE COSTS, AD FEES OR BUY IT NOW
ITEM FEES SHALL BE PAID BEFORE LISTING.
20)
24-7AUCTION.COM SHALL NOT BE HELD LIABLE FOR ANY MALFUNCTIONS,
SHUTDOWNS OR ERRORS. 24-7AUCTION.COM SHALL CORRECT ANY SUCH BY EITHER EXTENDING
THE AUCTION OR RESTARTING THE AUCTION. ANY REMEDY WILL BE IN THE SELLERS BEST
INTEREST. No persons shall have any claims against Mercer Auction Co., LLC or
24-7auction.com or their employees or agents for any injuries or damages
sustained to or loss of property, or potential profits, that may occur at the
auction site.
